We, us and our mean the operator trading as Rubbish Removal Streatham.

2. Scope of Services

We provide a waste collection and rubbish removal service for households and businesses. Our services normally include attending the Premises, assessing the waste on site where required, loading the agreed items and transporting them for lawful disposal or recycling.

The specific scope of each job, including the type and estimated volume of waste and any special requirements (such as access constraints or timing), will be confirmed at the time of booking or during any on-site assessment before work begins.

We reserve the right to refuse to collect any waste that we reasonably consider unsafe, illegal, hazardous, prohibited by law or outside the scope of our licence or insurance.

3. Booking Process

3.1 Bookings may be made by telephone, email or any other booking method that we make available. When you make a booking, you confirm that you have the authority to do so and that all information you provide is accurate and complete.

3.2 You must provide the Premises address, contact details, preferred date and time window for collection, and a clear description of the waste to be removed, including approximate volume, type of items and any access issues such as limited parking, stairs or restricted entry.

3.3 Any quote provided prior to arrival is based on the information you supply. If, on arrival, we find that the waste is substantially different in volume, weight, type or location from that described, we may revise the price or refuse to carry out the work if agreement on a revised price cannot be reached.

3.4 A booking is only confirmed when we have accepted it and given you a booking reference, confirmation message or email. We reserve the right to decline any booking at our discretion.

4. Access and Customer Responsibilities

4.1 You are responsible for ensuring that we have safe, timely and reasonable access to the Premises and to the waste that is to be collected. You must ensure that any necessary permissions, keys, entry codes or parking arrangements are in place before our team arrives.

4.2 If access is delayed, obstructed or refused, or if the waste is not available for collection at the agreed time, we may charge a waiting fee, an aborted journey fee or a rescheduling fee. Such charges will be communicated to you where applicable.

4.3 You must clearly identify the waste that is to be removed and separate it from any items that you wish to keep. Our team will not be responsible for removing any items that were not clearly presented or identified as waste.

4.4 You must ensure that the waste can be safely accessed, handled and removed. Where waste is stored in high or difficult-to-reach areas, cellars, lofts or other challenging locations, you must inform us in advance so that we can assess any additional labour or safety requirements.

5. Price, Quotations and Payments

5.1 Prices are usually based on the volume and type of waste, the labour required, access conditions and any additional services requested. We may provide an indicative quote in advance and confirm or adjust this once our team has seen the waste in person.

5.2 Quotations are normally given on a good faith basis but do not constitute a binding offer until confirmed on site. If the actual load is smaller than originally quoted, the price may be reduced accordingly. If the load is larger or more complex, we will provide a revised price before proceeding.

5.3 Unless agreed otherwise in writing, payment is due in full upon completion of the collection and before our team leaves the Premises. We may accept payment by cash, card or other methods that we make available from time to time.

5.4 For business Customers, we may agree to invoice on completion. Payment terms will be stated on the invoice. If no specific terms are stated, payment is due immediately on receipt of the invoice.

5.5 If payment is not made when due, we reserve the right to charge interest on overdue sums in accordance with applicable UK law and to recover any reasonable costs incurred in enforcing payment.

6. Cancellations and Rescheduling

6.1 You may cancel or reschedule a booking by contacting us as soon as possible and providing your booking details.

6.2 If you cancel with adequate notice, which will normally be at least 24 hours before the scheduled arrival time, no cancellation fee will usually be charged. Where shorter notice is given, we may charge a late cancellation fee to cover our costs and lost opportunity.

6.3 If our team has already been dispatched or has arrived at the Premises and the job is cancelled or cannot be completed due to issues outside our control, we may charge an aborted journey fee and, where applicable, a waiting fee.

6.4 We may cancel or reschedule a booking if we are unable to attend due to circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, illness, accidents or transport disruption. In such cases, we will aim to notify you as soon as practicable and agree a new appointment time. We will not be liable for any loss or inconvenience arising from such changes.

7. Waste Types and Prohibited Items

7.1 We collect general household and commercial rubbish, furniture, appliances, garden waste and similar non-hazardous materials. We may also collect certain bulky items subject to assessment.

7.2 We do not normally collect hazardous, toxic or specialist waste, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, pressurised containers, gas bottles, flammable liquids, explosives, radioactive materials or any other items classified as hazardous under UK law.

7.3 It is your responsibility to inform us in advance if any items for collection may contain hazardous substances or require special handling. If hazardous items are discovered on site, we may refuse to collect them and may charge for any time already spent or costs incurred.

7.4 Electrical and electronic equipment may be collected subject to compliance with relevant regulations. We reserve the right to decline any item that is unsafe to handle or transport.

8. Waste Regulations and Disposal

8.1 We operate in accordance with applicable UK waste management and environmental regulations. We will use licensed waste transfer stations and recycling facilities wherever reasonably possible.

8.2 By using our services, you confirm that you are the owner of the waste or have full authority from the owner to arrange its removal and disposal. Once collected, ownership of the waste transfers to us, and we will handle its disposal lawfully.

8.3 You agree not to request that we dispose of waste illegally or in a manner contrary to environmental regulations. We will not fly-tip or dispose of waste at unauthorised locations.

8.4 We may issue or receive waste transfer documentation as required by law. Upon request, and where applicable, we may provide a basic record of the collection, although this may not constitute a formal certificate of destruction unless specifically agreed.

9. Liability and Insurance

9.1 We will exercise reasonable care and skill when providing the services. However, we will not be liable for any loss, damage or costs arising from inaccurate information provided by you, failure to provide safe access, or the presence of hidden defects, unsafe structures or dangerous materials at the Premises.

9.2 While our team will take reasonable care when removing waste, minor scuffs or marks can sometimes occur, particularly in tight spaces or where large or heavy items must be removed. You accept this risk and agree that our liability for cosmetic damage of this nature will be limited unless caused by our negligence.

9.3 Our total liability to you for any loss or damage arising from our services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the specific job, except where such limitation is not permitted by law.

9.4 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be limited or excluded under UK law.

9.5 You are responsible for securing or removing any personal belongings or valuable items from areas where we are working. We will not be liable for any items that were not clearly identified as waste but were left in or on items presented for removal.

10. Customer Conduct and Health and Safety

10.1 You agree to treat our staff with respect and to refrain from abusive, threatening or inappropriate behaviour. We reserve the right to withdraw our team and terminate the job if they are subject to unreasonable conduct.

10.2 Our staff are authorised to stop work if they consider the conditions unsafe, including but not limited to structural concerns, aggressive behaviour, hazardous materials or extreme weather. In such cases we may reschedule or cancel the job and apply reasonable charges for time already spent.

10.3 You must not ask our staff to undertake tasks that fall outside the agreed services or that might compromise their safety or breach regulatory requirements.

11. Delays and Service Times

11.1 We aim to attend within an agreed time window, but all arrival times are estimates and may be affected by traffic, weather, operational issues or other circumstances beyond our reasonable control.

11.2 We will use reasonable efforts to keep you informed of significant delays and to minimise any inconvenience. However, we are not liable for any loss, costs or damages arising from early or late arrival, provided we attend on the day of the booking or an alternative date agreed with you.

12. Complaints and Disputes

12.1 If you are dissatisfied with any aspect of our service, you should raise your concerns with us as soon as possible, ideally within 48 hours of completion of the job, so that we can investigate and respond promptly.

12.2 We will review any complaint in good faith and may request further information or evidence from you. Where appropriate, we may offer a remedy such as a partial refund, re-attendance, or other proportionate outcome. Any remedy will be at our reasonable discretion, subject to your legal rights.

12.3 If a dispute cannot be resolved between us, you may have the right to pursue the matter through the courts or any applicable alternative dispute resolution scheme as permitted by UK law.

13. Data Protection and Privacy

13.1 We will handle any personal data you provide in the course of booking or receiving our services in accordance with applicable data protection laws.

13.2 We will use your personal information to manage your booking, provide the services, process payments, and communicate with you regarding your waste collection. We may also retain records as required for legal, regulatory or accounting purposes.

13.3 We will not sell your personal data to third parties. We may share it with our staff, contractors, insurers or professional advisers where required for the provision of services, legal compliance or legitimate business interests.

14. Amendments to These Terms

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services we provide, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these terms shall operate as a waiver of that right or remedy, nor shall any single or partial exercise of any right or remedy prevent any further exercise of that or any other right or remedy.

16.3 These Terms and Conditions constitute the entire agreement between you and us in relation to the services, and supersede any prior understandings, representations or agreements, whether verbal or written, regarding rubbish removal or waste collection services provided by us.
